What is an E.U.C.C. (Entidad Urbanística de Colaboración y Conservación)
Urban conservation entities are entities of public law, compulsory affiliation and personality and legal capacity for the fulfilment of its purposes, since its registration in the register of collaborating planning institutions. They are subject to the supervision of the municipality.
Its purpose is the conservation of the development works, including the maintenance of the provisions and the corresponding utilities (conservation of roads, maintenance of public lighting, maintenance of green areas). They are entities of collaboration of the Town Hall. Although similarities can be made with the Community of Owners, there are basic differences such as their public administrative legal nature, being a body in collaboration with the Town Council as well as the goods and services that should be kept are, mainly, in the public domain, not private. They have administrative nature and are governed by their own statutes and the existing urban or regulatory rules governing them (of the land law, regulation of urban management,...). Only in a subsidiary manner may apply the rules of the Horizontal property law governing the community of owners.
Statutes establishing both a series of rights as obligations to members of the entity, as well as determine the governing bodies that entrusted them the Management and the administration of it, such as the Assembly that will be composed by all the owners and the Management Committee.
Precisely because of this administrative nature, it is the corresponding town hall which must approve its Constitution, modification, extinction, as well as approve the statutes and other regulations governing the same. Also, provides that there is a representative of the Administration as a link of information between the bodies of the Organization and the Town Council, which will have voice, but no vote in the governing bodies of the conservation entity.
The urban conservation entity membership is compulsory for all owners of houses, plots, commercial premises and buildings of all kinds, included within its scope. The entity governing bodies are the General Assembly, the Management Committee and the President.
